Terms of Service

These Terms of Service ("Terms") govern your use of the Wayne Noel website and services. By booking a session, creating an account, or using this website, you agree to these Terms.

1. Services

Wayne Noel provides somatic bodywork, somatic coaching, sound work, breathwork, and related complementary wellness services. These services are complementary wellness practices and are not a substitute for medical diagnosis, treatment, or professional mental health care. You should consult your healthcare provider before beginning any new wellness practice.

2. Booking and Payment

Sessions are confirmed upon successful payment. All prices are listed in US dollars and are subject to change. Payment is processed securely through Stripe. By completing a purchase, you authorize me to charge your selected payment method for the amount shown at checkout.

3. Cancellation and Refund Policy

Cancellations made more than 24 hours before your scheduled session receive a full refund. Late cancellations (within 24 hours) may be subject to a cancellation fee up to the full session amount. No-shows will be charged the full session price. For mobile sessions, travel fees are non-refundable if the practitioner has already departed.

4. Session Packages

Session packages are prepaid bundles of sessions sold at a discounted rate. Packages are non-refundable and non-transferable. Each package has a validity period stated at the time of purchase. Unused sessions expire at the end of the validity period and cannot be refunded or extended.

5. Memberships

Memberships are recurring subscriptions billed monthly via Stripe. You may cancel your membership at any time through your client portal or by contacting me. No refunds are issued for partial billing periods. Unless otherwise specified, unused sessions do not roll over to the next billing cycle.

6. Gift Certificates

Gift certificates are non-refundable and cannot be exchanged for cash. Gift certificates do not expire. The certificate value is applied at checkout using the unique gift code provided at purchase.

7. Client Portal

Your client portal account provides access to your booking history, upcoming sessions, packages, memberships, and messages. You are responsible for maintaining the security of your login credentials. If you suspect unauthorized access, please contact me immediately.

8. SMS/Text Message Communications

I offer optional text message (SMS/MMS) notifications for appointment-related communications. By opting in to receive text messages, you agree to the following:

  • Consent: By enabling SMS Notifications in your client portal or providing consent during booking, you expressly agree to receive recurring automated text messages at the phone number you provided. Consent is not a condition of purchasing any service.
  • Message types: Messages include appointment confirmations, reminders (typically 24 hours before your session), cancellation notices, rescheduling updates, and responses to your inquiries.
  • Message frequency: Frequency varies based on your appointment schedule, typically 1-4 messages per booked session.
  • Opt-out: You may opt out at any time by replying STOP to any text message or by disabling SMS Notifications in your client portal account settings. You will receive a one-time confirmation and no further messages.
  • Help: Reply HELP for assistance or visit the contact page.
  • Rates: Message and data rates may apply. Your mobile carrier's standard messaging rates apply. I am not responsible for carrier charges.
  • Carriers: Supported carriers include AT&T, Verizon, T-Mobile, Sprint, and most other US carriers. Service may not be available on all carriers.
  • Privacy: Your phone number and SMS opt-in information will not be sold or shared with third parties for marketing purposes. See the Privacy Policy for full details.

9. Health Disclaimer

Somatic bodywork, somatic coaching, sound work, breathwork, myofascial release, and related modalities are complementary wellness services. They are not medical treatments. By booking a session, you acknowledge that:

  • You are voluntarily participating in a wellness service
  • You have disclosed any relevant health conditions
  • You will seek medical attention for any medical concerns
  • Results vary and are not guaranteed

10. Limitation of Liability

To the fullest extent permitted by law, Wayne Noel shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising out of or relating to your use of my services, this website, or the client portal, including any damages arising from unauthorized access to your information, whether based in contract, negligence, or any other legal theory. Except for liabilities that cannot be limited under applicable law, my total liability for any and all claims shall not exceed the greater of the amount you paid for the specific service giving rise to the claim, or one hundred dollars. Nothing in these Terms limits liability for gross negligence, fraud, or willful misconduct, or any other liability that cannot be excluded under California law.

11. Website Provided As Is

This website, the client portal, and any online tools are provided on an as is and as available basis. To the fullest extent permitted by law, Wayne Noel makes no warranties of any kind, express or implied, about the website or portal, and does not warrant that they will be uninterrupted, error free, or completely secure. This applies to the technology and does not limit any rights you have under consumer protection law.

12. Data Security and Assumption of Risk

Wayne Noel takes commercially reasonable steps to protect your information, described in the Privacy Policy. You acknowledge that no website, database, or method of electronic storage or transmission is completely secure, and that you provide your information at your own risk. While reasonable measures are in place, Wayne Noel cannot guarantee that an unauthorized third party will never defeat those measures.

13. Indemnification

To the fullest extent permitted by law, you agree to hold harmless and indemnify Wayne Noel from any claims, losses, or expenses, including reasonable attorney fees, arising out of your violation of these Terms, your misuse of the website or portal, or your violation of any law or the rights of another person. This does not require you to cover any loss caused by Wayne Noel's own gross negligence or willful misconduct.

14. Third-Party Services

My services rely on trusted outside providers, including Stripe for payment processing, Google for calendar services, and a messaging provider for text messages. Card payments are handled entirely by the payment processor, and full payment-card numbers are never received or stored on this website. Each provider maintains its own security and privacy practices. To the fullest extent permitted by law, Wayne Noel is not responsible for the acts, omissions, or data incidents of these independent third-party providers.

15. Intellectual Property

All content on this website, including text, images, logos, and design, is the property of Wayne Noel and is protected by copyright law. You may not reproduce, distribute, or create derivative works without written permission.

16. Changes to These Terms

I may update these Terms periodically. Changes will be posted on this page with an updated revision date. Continued use of my services after changes constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Sonoma County, California.
